These Terms of Use ("Terms") are an agreement between you and Merkel LLC ("we", "us", "our"). They apply when you use Pelvia: the Pelvia mobile app (the "App"), the Pelvia quiz and web pages on getpelvia.com (the "Website"), and any subscription you buy (together, the "Service").
By using the Service or buying a subscription, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Pelvia offers guided pelvic floor (Kegel) exercises and general information. Pelvia does not give medical advice. It does not diagnose, treat, cure or prevent any disease or condition, and it does not replace a doctor, midwife, physiotherapist or other health professional.
You must be at least 18 years old, and able to make a binding contract, to use the Service or buy a subscription.
We give you a personal, non-exclusive, non-transferable, revocable right to use the Service for your own non-commercial use, under these Terms.
You agree not to:
Some features, such as the guided sessions, need a paid subscription ("Premium"). Plans and prices are shown before you buy.
Your subscription renews automatically at the end of each period (for example every month or every 3 months) at the price shown when you bought it, until you cancel. You pay for each new period at the start of that period.
If you subscribe in the App, Apple (App Store) or Google (Google Play) charges your store account and handles renewals, cancellation and refunds under its own terms.
If you subscribe on our Website, our payment provider Stripe charges your payment method.
We may change subscription prices. We will tell you in advance, and where the law requires, ask for your agreement. A new price applies from your next renewal. If you do not agree, you can cancel before the new price applies.
If we offer a free trial or a discounted first period, we show its length and the price after it before you start. Unless you cancel before the trial or offer ends, your subscription continues at the normal price.
If you got the App from the Apple App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. Apple and Google are not responsible for the App or its support, and are not parties to these Terms. Where these Terms and the store's terms conflict for a store purchase, the store's terms apply.
The Service, including its text, exercises, design, graphics, sounds and software, belongs to us or our licensors and is protected by law. These Terms do not give you any ownership of it.
If you send us feedback or ideas, we may use them without any obligation to you.
The Service uses services from other companies, such as Apple, Google, Stripe and RevenueCat. Their own terms and privacy policies apply to them. We are not responsible for them.
We may change, add or remove features of the Service. If we stop the Service or remove a paid feature you have paid for, we will tell you and, where the law requires, give you a fair refund for the unused period.
You can stop using the Service at any time. Deleting the App does not cancel a subscription: cancel it as section 4 explains.
We may suspend or end your access if you break these Terms or the law. Sections 1, 6 and 10 to 13 stay in force after your access ends.
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will always be available, without errors, or give any specific result.
To the extent the law allows:
Nothing in these Terms limits liability that the law does not allow us to limit, such as liability for death or personal injury caused by our negligence, or for fraud.
You agree to protect us from claims, losses and costs (including reasonable legal fees) that come from your breach of these Terms or your misuse of the Service.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. The state and federal courts in Broward County, Florida, have exclusive jurisdiction over any dispute about these Terms or the Service.
If you are a consumer in the EU, the UK or another country whose law gives you rights that a contract cannot remove, you keep those rights, and you can also bring a claim in the courts of the country where you live.
If you live in the EU or the UK, you normally have the right to withdraw from a contract for digital content or services within 14 days. When you buy a subscription, you ask us to give you access at once, and you agree that you lose this right of withdrawal once access starts, as the law allows.
We may update these Terms. We will post the new version here and change the "Last updated" date. If a change is important, we will tell you in advance, for example by email or in the App. If you keep using the Service after the change applies, you accept the new Terms.
If a court finds a part of these Terms invalid, the rest stays in force. If we do not enforce a right, we do not give it up. You may not transfer your rights under these Terms. We may transfer ours, for example if we sell our business. These Terms and our Privacy Policy are the whole agreement between you and us about the Service.
