Pelvia Privacy Policy

This Privacy Policy explains how Merkel LLC ("we", "us", "our") collects, uses and shares personal information when you use Pelvia. "Pelvia" means:

the Pelvia mobile app for iPhone and Android (the "App"),
the Pelvia quiz and web pages on getpelvia.com and its subdomains (the "Website"),
our checkout pages and the emails we send you.

If you do not agree with this policy, please do not use Pelvia.

2. Pelvia does not give medical advice

Pelvia offers guided pelvic floor (Kegel) exercises. It does not diagnose, treat or cure any condition. Stop if you feel pain or discomfort and ask your doctor for advice. See our Terms of Use for more.

3. What we collect

3.1 When you take the quiz

Your answers. The quiz asks about you and your goals, for example about bladder control, pregnancy or childbirth. Some answers can be health information. See section 4.
Your email address, if you give it to us.
Your choices about consent and emails.
A quiz ID that links your answers to your later purchase.
Device and usage information, such as browser type, device type, pages viewed, clicks, approximate location from your IP address, and the ad or link that brought you to us.

3.2 When you buy on our Website

Our payment provider, Stripe, collects your payment card details, email address and billing details. We never receive or store your full card number. We receive your email address, country, the plan you chose, the price, and the status of your payment and subscription.

3.3 When you use the App

No account. You do not need an account or a login to use the App.
Exercise data stays on your phone. Your exercise history, progress, level, settings and reminder times are stored only on your device. We do not receive them. If you delete the App, this data is deleted.
Reminders are local. Your phone schedules reminder notifications. The App does not send us a push token, your time zone or your reminder times.
Subscription information. Our subscription provider, RevenueCat, gives the App a random user ID. RevenueCat receives your purchase and subscription status, and technical information such as device type, operating system version, App version, language, country and IP address. If you bought on our Website, the link that opens the App carries this user ID, so your purchase unlocks the App.
Store purchases. If you subscribe in the App, Apple or Google processes the payment. We receive the status of the subscription, not your payment details.
No ads and no tracking in the App. The App has no advertising code and no analytics code. It does not track you across other companies' apps or websites.

3.4 When you contact us

If you email us, we receive your email address and what you write to us.

4. Health information

Some quiz answers, for example about bladder control or pregnancy, are health information. Many laws give this information extra protection. For example, the EU and UK General Data Protection Regulation (GDPR) treats it as special category data, and some US states (such as Washington and Nevada) treat it as consumer health data.

We collect it only with your consent. The quiz asks for your consent before you answer. You can withdraw your consent at any time (see section 9). This does not affect what we did before you withdrew it.
We use it only to: show you a plan that fits your answers, understand which plans and quiz versions work best, and improve Pelvia.
We never sell it.
We do not give your quiz answers to advertising companies.
We share it only with the service providers in section 6 that host the quiz and help us run it, under contracts that limit their use of it.

We do not make decisions about you that have legal or similarly significant effects based only on automated processing.

6. Who we share it with

We share personal information only with service providers that help us run Pelvia. They may use it only to provide their service to us.

if the law, a court or a government authority requires it,
to protect the rights, safety and property of our users, us or others,
if we sell or merge our business, in which case the buyer must protect your information as this policy describes.

We do not sell your personal information.

7. Cookies and similar tools

Our Website uses cookies and similar tools to make the quiz and checkout work, to measure ads, and to understand how visitors use the pages. Where the law requires consent, we ask for it first. You can also block or delete cookies in your browser settings. Some parts of the Website may not work without them.

The App does not use cookies or advertising identifiers.

8. How long we keep it

9. Your rights

Depending on where you live, you can ask us to:

tell you what personal information we have about you, and give you a copy,
correct it,
delete it,
limit or stop how we use it, or object to how we use it,
send it to you or to another company in a common format,
withdraw a consent you gave us, at any time.

If you live in the EU, the UK or Switzerland, you can also complain to your local data protection authority.

If you live in California or another US state with a privacy law, you can ask to know, delete and correct your personal information, and opt out of any sale or sharing of it for targeted advertising. We do not sell personal information. We will not treat you differently because you used your rights.

Consumer health data (for example in Washington and Nevada): you can ask us to confirm whether we collect, share or sell your consumer health data, get a list of the third parties we share it with, get a copy, delete it, and withdraw your consent. We do not sell consumer health data.

How to use your rights: email info@merkelapps.com. We may need to confirm your identity first, for example by asking you to reply from the email address you used with us. We answer within the time the law requires, usually within 30 to 45 days. If we refuse your request, we tell you why, and where the law gives you a right to appeal, how to appeal.

Emails: each marketing email has an unsubscribe link.

10. International transfers

We are based in the United States, and our service providers may process information in the United States and other countries. When we transfer personal information from the EU, the UK or Switzerland, we use legal safeguards such as the European Commission's Standard Contractual Clauses.

11. Security

We use reasonable technical and organisational measures to protect your information, such as encrypted connections and limited access. No method of transfer or storage is fully secure, so we cannot guarantee absolute security.

12. Children

Pelvia is for adults. It is not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child gave us personal information, contact us and we will delete it.

13. Changes to this policy

We may update this policy. We will post the new version here and change the "Last updated" date. If a change is important, we will tell you, for example by email or in the App.
